§ 13.1.16. Alternative Equivalent Compliance (AEC)

    Intent: Provide Plaza designers the flexibility to meet the intent of these standards with a design solution that is equal to or greater in design excellence as identified in each section. AEC shall not be used when the design intent can be achieved by following the standards herein.

    b.

    Alternative Equivalent Compliance may be granted by the Director of Planning upon finding of the following criteria:

    i.

    The requested modification is in general conformity with the stated intents of these recommendations;

    ii.

    The requested modification meets all other applicable zoning, building, drainage, water quality, and safety code requirements;

    iii.

    The requested modification will have no significant adverse impact on the health, safety, or general welfare of surrounding property owners or the general public, or such impacts will be substantially mitigated; and

    iv.

    The requested modification is necessary to compensate for some practical difficulty or some unusual aspect of the site of the proposed development not shared by landowners in general including, but not limited to terrain and elevation changes, natural features, and shape of Plaza.
