§ 10-5-62. PERMIT REQUIRED FOR SLOP AND SWILL HAULER.

  • (A)

    A person must obtain a permit from the health authority to haul or transport slop or swill.

    (B)

    Before the health authority issues a permit under this section, the health authority shall inspect each vehicle or container used to haul or transport slop or swill.

    (C)

    The health authority may inspect a vehicle or container used under this section at any time to determine compliance with this section.

    (D)

    A person who hauls or transports slop or swill shall enclose the slop or swill in a securely covered metal container designed to prevent spillage or entry by an insect.

    (E)

    The health authority shall issue a permit under this section if the applicant complies with the application requirements prescribed by the health authority and pays the fees established by separate.

    (F)

    A permit issued under this section is:

    (1)

    valid for one year from the date of issuance;

    (2)

    non-transferable; and

    (3)

    annually renewable, if the permittee pays the fee established by separate ordinance.

    (G)

    The health authority may revoke or suspend a permit if:

    (1)

    the permittee fails or refuses to comply with the terms of the permit; or

    (2)

    the health authority determines that the permittee is hauling or transporting slop or swill to a location where the use, storage, or processing of the slop or swill creates or contributes to a public health hazard.
