§ 11-1-64. NOTICE OF DENIAL; APPEAL.

  • (A)

    If the Landmark Commission determines that an applicant is not eligible for an abatement, the director shall notify the applicant in writing by United States mail sent to the address shown on the application.

    (B)

    An applicant may appeal the Landmark Commission's decision to the Planning Commission. To appeal, the applicant must file a written request with the director not later than the 31st day after the date written notice of the decision is given to the applicant.

    (C)

    On appeal, the Planning Commission shall consider only whether the Landmark Commission erred in its determination that the applicant is not eligible for the abatement under Section 11-1-63 ( Criteria For Eligibility ).
