§ 14-9-32. RESTRICTIONS ON NEWSRACK LOCATION.

  • (A)

    A person may not install, use, or maintain a newsrack on a portion of a street or right-of-way on which a motor vehicle may operate.

    (B)

    A person may not install, use, or maintain a newsrack on a street, sidewalk, or right-of-way, if the newsrack:

    (1)

    endangers public safety;

    (2)

    interferes with public utility, public transportation, or other governmental use; or

    (3)

    interferes with or impedes:

    (a)

    pedestrian or vehicular traffic;

    (b)

    entry or exit from a residence or business;

    (c)

    access to a legally parked or stopped vehicle;

    (d)

    use of a traffic sign or signal, emergency call box, transit shelter, elevator, mailbox, or other public service; or

    (e)

    access to or use of a delivery area or loading zone.

    (C)

    A person may not install, use, or maintain a newsrack less than three feet from a fire hydrant, marked pedestrian crosswalk, designated handicapped parking space or handicapped ramp facility, or in a location that results in less than five linear feet of open space for pedestrian use.

    (D)

    A person may not install a newsrack that is:

    (1)

    less than 12 inches from a property line;

    (2)

    less than 18 inches from a curb line; or

    (3)

    taller than 58 inches.
