§ 15-3-60. CRIMINAL PENALTIES.

(A)

A person who acts with criminal negligence and violates this article, the terms of a permit, order, or agreement issued under this article, or a rule promulgated to implement this article commits a Class C misdemeanor punishable under Section 1-1-99 ( Offenses; General Penalty ).

(B)

Each day that a violation occurs is a separate offense.

(C)

Proof of a higher degree of culpability than criminal negligence constitutes proof of the culpability charged.
