§ 15-4-37. STATEMENT OF INTENT TO CONTAIN ALL REQUIRED INFORMATION.
(A)
For purposes of the time limits prescribed by Section 13.187 ( Statement of Intent to Change Rates; Hearing; Determination of Rate Level ) of the Texas Water Code, a statement of intent is not filed with the City until it contains substantially all the information required by this division. A statement of intent is sufficient to initiate the time limits under Section 13.187 ( Statement of Intent to Change Rates; Hearing; Determination of Rate Level ) of the Texas Water Code unless the director notifies the public utility under this section.
(B)
If a statement of intent is insufficient, the director must notify the public utility not later than:
(1)
the 10th day after the date the statement is filed if the rate changes are not major changes; and
(2)
the 30th day after the date the statement is filed if the rate changes are major changes.
(C)
The director's notice under this section shall be in writing and specify each insufficiency with particularity.
(D)
If notice of insufficiency is given, the time limits prescribed by Section 13.187 ( Statement of Intent to Change Rates; Hearing; Determination of Rate Level ) of the Texas Water Code begin to run at the time that all of the insufficiencies are corrected.
