§ 15-7-4. FEES AND CHARGES.

(A)

The director may establish fees to administer this chapter and for the use of utility infrastructure to the extent not otherwise established by ordinance and as may be consistent with state law.

(B)

Filing fees and usage charges shall be calculated and applied in a consistent manner for all similarly situated users. If federal or state law or regulation preempts a filing fee or usage charge under this chapter, the filing fee and usage charge collected by the City shall be the lesser of:

(1)

the maximum amount permitted by federal or state law or regulation, or

(2)

the utility's cost to provide the service or value of the right granted as determined by the director.

(C)

The director may waive the filing and usage fees for an attachment if the attachment is used exclusively for the provision of wireless service to the public free of charge on an open, non-discriminatory basis.
