§ 1-1-13. BURDEN OF PROOF OF EXCEPTIONS.

  • In a prosecution for the violation of a provision of the Code, it is not necessary for the complaint to negate or for the state to prove an exception in the Code concerning a prohibited act. The person charged in a complaint may urge an exception as a defense.
