§ 25-2-809. RESTAURANT (LIMITED) USE.

  • (A)

    In a neighborhood commercial (LR) district, a restaurant (limited) use is:

    (1)

    a conditional use if it has drive-in service; and

    (2)

    prohibited if it exceeds 3,000 square feet of gross floor area, and the site abuts property:

    (a)

    zoned as an urban family residence (SF-5) or more restrictive district; or

    (b)

    on which a use permitted in a SF-5 or more restrictive district is located.

    (B)

    in a general office (GO), commercial recreation (CR), or neighborhood commercial (LR) district, the outdoor seating area, if any, for a restaurant (limited) use may not exceed 50 percent of the indoor seating area. Seating area is measured in square feet.
