§ 2-10-1. JURISDICTION AND AUTHORITY.

  • A municipal court, including the Downtown Austin Community Court has:

    (1)

    the general jurisdiction provided by Chapter 30 ( Municipal Courts of Record ) of the Texas Government Code;

    (2)

    civil jurisdiction to enforce a municipal ordinance adopted under Subchapter A, Chapter 214 ( Dangerous Structures ) of the Texas Local Government Code or Subchapter E, Chapter 683 ( Junked Vehicles; Public Nuisance; Abatement ) of the Texas Transportation Code;

    (3)

    concurrent jurisdiction with a district court or a county court at law under Subchapter B, Chapter 54 ( Municipal Health and Safety Ordinances ) of the Texas Local Government Code, to enforce a health and safety or nuisance abatement ordinance:

    (a)

    within the city limits; and

    (b)

    on property owned by the City that is located in the City's extraterritorial jurisdiction; and

    (4)

    authority to issue:

    (a)

    a search warrant to investigate a health and safety or nuisance abatement ordinance violation; and

    (b)

    a seizure warrant to secure, remove, or demolish property or remove debris found in violation of a health and safety or nuisance abatement ordinance.
