§ 2-9D-24. POST-AWARD CHANGES TO THE SCOPE OF WORK.

  • (A)

    Changes to the Contract shall be documented by the Contract Awarding Authority at the time they arise, to establish the reasons for the change and to document resulting changes in the applicable Goals for the Contract.

    (B)

    It is the duty of the Contractor to fulfill the Goals or to make Good Faith Efforts to fulfill the Goals for that changed Contract.

    (C)

    For professional and nonprofessional services Contracts, when there is a change to the scope of work which requires new, additional services beyond the services originally required to accomplish the project, then it is the duty of the Proposer to fulfill the applicable contracted Goals or Subgoals or to make Good Faith Efforts to fulfill the applicable contracted Goals or Subgoals for that change. Changes to the scope of work which do not alter the type of services as originally required to accomplish the project may be undertaken using the Subconsultants, Subcontractors and suppliers already under Contract to the Proposer.
