§ 30-5-232. DEDICATED FUND.

(A)

The city's director of finance shall establish a dedicated fund to:

(1)

monitor water quality controls; and

(2)

maintain water quality controls for single-family and duplex residential development.

(B)

An applicant shall pay the required fee into the fund:

(1)

for development that does not require a site plan, when the applicant posts fiscal security for the subdivision or requests that the single office record the subdivision plat, whichever occurs first; or

(2)

for development that requires a site plan, when the site plan is approved.

(C)

The Watershed Protection Department director shall administer the fund, allocate the fund for appropriate projects, and report annually to the council regarding the status of the fund and the monitoring and maintenance program described in this section.
