§ 4-9-6. NOTICE OF APPLICATION FOR WAIVER.

  • (A)

    The director shall distribute notice of an application for a waiver under Section 4-9-5 ( Waiver of Minimum Distances ) by:

    (1)

    publication in a newspaper of general circulation in the location in which the waiver is requested; and

    (2)

    mail not fewer than 15 days before the date of the council's public hearing under this section to:

    (a)

    the applicant;

    (b)

    the record owner of real property located within 300 feet of the proposed place of business; and

    (c)

    a neighborhood organization on file with the City that has requested notice of an application for the waiver under this chapter; and

    (3)

    posting one to three signs in the location for which the waiver is requested.

    (B)

    A sign posted under Subsection (A)(3) shall:

    (1)

    include the type of action pending, the file number, and a contact telephone number for additional information;

    (2)

    be visible from the street; and

    (3)

    be spaced not more than 200 feet apart, unless the street frontage of the place of business requesting a waiver is less than 200 feet, in which case, only one sign is required.

    (C)

    An applicant may post the signs required under Subsection (B). If the applicant assumes responsibility for posting the signs required under Subsection (B), the applicant must:

    (1)

    verify placement of the signs in writing to the director; and

    (2)

    respond to complaints regarding the signs to the director within 24 hours.

    (D)

    A person may not remove a sign posted by the director under this section before the earliest date council action may be taken on the application.
