Article 2. PERMITS. |
§ 6-2-12. APPLICATION AND ISSUANCE PROCEDURE.
(A)
The director shall approve an application for a hazardous material storage permit if the applicant:
(1)
files a materials management plan in accordance with Article 3 ( Materials Management Plan );
(2)
complies with the design requirements of Article 5 ( Containment Design Requirements ); and
(3)
pays the permit fee in accordance with Section 6-2-14 ( Fees ).
(B)
The director shall approve or deny an application:
(1)
for a new storage facility, not later than the 30th day after the date it is submitted; or
(2)
for an existing storage facility, not later than the 180th day after the date it is submitted.
(C)
If the director does not approve or deny an application for a new storage facility within the time period prescribed by Subsection (B), the application is deemed approved.
