§ 6-2-53. RIGHT OF ENTRY.

  • (A)

    An authorized City employee may enter a structure or premise at a reasonable time to perform an inspection or duty under this chapter if the employee has reasonable cause to believe that a violation of this chapter exists in the structure or on the premise and that the entry is necessary to enforce this chapter.

    (1)

    If a structure or premise is occupied, the employee shall present the employee's credentials and request entry.

    (2)

    If a structure or premise is not occupied, the employee shall make a reasonable effort to contact a responsible person and request entry.

    (B)

    If entry is refused or the employee is not able to contact a responsible person to request entry, the employee requesting entry may seek recourse to every remedy provided by law to secure entry.
