§ 6-5-43. PERMIT AND CERTIFICATE OF COMPETENCY REQUIRED.

  • (A)

    Except for water distributed by a governmental entity, a person may not provide drinking water unless the person first obtains a permit from the health authority and pays the permit fee established by separate ordinance.

    (B)

    A person may not provide drinking water for a charge unless the person:

    (1)

    employs an operator who holds a certificate of competency issued by the Texas Commission on Environmental Quality; and

    (2)

    submits samples as required by the health authority for chemical and bacteriological analysis.
