Article 5. DISCHARGES INTO STORM SEWERS OR WATERCOURSES. |
§ 6-5-54. CAR WASHES, SERVICE STATIONS, AND SIMILAR FACILITIES.
(A)
This section applies to a car wash, service station, fuel dispensing facility, oil change or lubrication station, vehicle repair shop, or other similar facility.
(B)
The owner or operator of a facility constructed after January 9, 1978:
(1)
shall provide oil, grease, and sand traps that comply with Section 6-5-52 ( Traps, Catch Basins, and Interceptors ) for the drainage from an area that is exposed to rainfall;
(2)
shall treat rainfall runoff and discharge it to the nearest storm sewer or watercourse; and
(3)
may not discharge or allow to be discharged drainage from an area that is protected from rainfall to a storm sewer or watercourse.
(C)
This subsection applies to a facility that was constructed before January 10, 1978 and that discharges drainage to a storm sewer or watercourse.
(1)
The owner or operator of a facility shall comply with Section 6-5-51 (Discharge Restrictions).
(2)
The director shall inspect the facility and may sample the drainage being discharged.
(a)
If an inspection or sample indicates a violation of Section 6-5-51 ( Discharge Restrictions ), director shall notify the facility owner or operator of the violation.
(b)
The owner or operator shall submit to the director a proposal to correct the violation not later than the 30th day after the date of the notification.
(c)
Not later than the 15th day after the director receives a proposal to correct a violation, the director shall approve the proposal or order other corrective action. The director shall allow an owner or operator a reasonable period of time to correct the violation.
