§ 9-4-12. GLASS CONTAINERS PROHIBITED IN CERTAIN AREAS.
(A)
In this section:
(1)
GLASS CONTAINER means a glass receptacle, closed or capable of being closed.
(2)
GLASS CONTAINER AREA NO. 1 means the area:
(a)
that begins at the intersection of the south shore of Town Lake and the east curb of IH-35 East Frontage Road;
(b)
north on the east curb of IH-35 East Frontage Road to its intersection with the north curb of Martin Luther King, Jr. Boulevard;
(c)
west on the north curb of Martin Luther King, Jr. Boulevard to its intersection with the east curb of Lamar Boulevard (North);
(d)
south on the east curb of Lamar Boulevard (North) to its intersection with the south shore of Town Lake; and
(e)
east on the south shore of Town Lake to its intersection with the east curb of IH-35 East Frontage Road, the place of beginning.
(3)
GLASS CONTAINER AREA NO. 2 means the area:
(a)
that begins at the intersection of the south curb of Holly Street and the east curb of IH-35 East Frontage Road;
(b)
north on the east curb of IH-35 East Frontage Road to its intersection with the north curb of 13th Street;
(c)
east on the north curb of 13th Street to its intersection with the east curb of Chicon Street;
(d)
north on the east curb of Chicon Street to the north curb of 14th Street;
(e)
south on the west curb of Chicon Street to the north curb of 13th Street;
(f)
east along the north curb of 13th Street to the point where 13th Street reaches a dead end west of Boggy Creek;
(g)
east in a straight line to the westernmost end of the north curb of 13th Street where 13th Street begins again to the east of Boggy Creek;
(h)
east along the north curb of 13th Street (East) to the east curb of Airport Boulevard;
(i)
south along the east curb of Airport Boulevard to the south curb of Oak Springs Drive;
(j)
west along the south curb of Oak Springs Drive to the east curb of Webberville Road;
(k)
south along the east curb of Webberville Road to its intersection with the south curb of Coronado Street;
(l)
west along the south curb of Coronado Street to its intersection with the west curb of Northwestern Avenue;
(m)
north along the west curb of Northwestern Avenue to its intersection with the south curb of Rosewood Avenue;
(n)
west along the south curb of Rosewood Avenue to the east curb of Poquito Avenue;
(o)
south along the east curb of Poquito Avenue to the south curb of Cornell Street;
(p)
west along the south curb of Cornell Street to the east curb of Chicon Street;
(q)
south along the east curb of Chicon Street to the south curb of Holly Street; and
(r)
west along the south curb of Holly Street to its intersection with the east curb of IH-35 East Frontage Road; the place of beginning.
(4)
GLASS CONTAINER AREA NO. 3 means the area:
(a)
that begins at the south shore of Town Lake at its intersection with the east curb of Congress Avenue (South);
(b)
south along the south shore of Town Lake to the intersection with Barton Springs Road;
(c)
west on the south adjoining property line of Barton Springs Road to the intersection with Dawson Road;
(d)
south along the east curb of Dawson Road to the point at which it becomes South Fifth Street;
(e)
south along the east curb of South Fifth Street to the intersection with Oltorf Street (West);
(f)
west on the south curb of Oltorf Street (West) to the intersection with Lamar Boulevard (South);
(g)
north on the east curb of Lamar Boulevard (South) to the intersection with Barton Springs Road;
(h)
west on the south adjoining property line of Barton Springs Road to the intersection with the east bank of Barton Creek;
(i)
north on the east bank of Barton Creek to the south shore of Town Lake; and
(j)
east along the south shore of Town Lake to the intersection with Congress Avenue (South), the place of beginning.
(5)
GLASS CONTAINER AREA NO. 4 means the area:
(a)
that begins at the intersection of the north curb of Martin Luther King, Jr. Boulevard and east curb of Guadalupe Street;
(b)
west along the north curb of Martin Luther King, Jr. Boulevard to its intersection with the west curb of Rio Grande Street;
(c)
north along the west curb of Rio Grande Street to its intersection with the south curb of 28th Street (West);
(d)
west along the south curb of 28th Street (West) to its intersection with the west curb of Salado Street;
(e)
north along the west curb of Salado Street to its intersection with the north curb of 29th Street (West);
(f)
east along the north curb of 29th Street (West) to its intersection with the east curb of Guadalupe Street; and
(g)
south along the east curb of Guadalupe Street to its intersection with the north curb of Martin Luther King Jr. Boulevard; the place of beginning.
(6)
GLASS CONTAINER AREA NO. 5 means the area:
(a)
that begins at the intersection IH-35 East Frontage Road and the north curb of Riverside Drive (East);
(b)
east along the north curb of Riverside Drive (East) to its intersection with the north curb of Lakeshore Boulevard (South);
(c)
east along the north curb of Lakeshore Boulevard (South) to its intersection with the east curb of Pleasant Valley Road (South);
(d)
south along the east curb of Pleasant Valley Road (South) to its intersection with the south curb of Willow Hill Drive;
(e)
west along the south curb of Willow Hill Drive to its intersection with the west curb of Willow Creek Drive;
(f)
north along the west curb of Willow Creek Drive to its intersection with the south curb of Woodland Avenue;
(g)
west along the south curb of Woodland Avenue to its intersection with the IH-35 East Frontage Road; and
(h)
along the east curb of the IH-35 East Frontage Road to its intersection with the north curb of Riverside Drive (East), the place of beginning.
(7)
GLASS CONTAINER AREA NO. 6 means the area:
(a)
that begins at the intersection of Montopolis Drive and the north curb of Grove Drive;
(b)
along the north curb of Grove Drive to its end; thence southwestward in a straight line (through City parkland) to the westernmost edge of the cul-de-sac of Ponca Street;
(c)
in a straight line from the westernmost edge of the cul-de-sac of Ponca Street to the northernmost point of the west curb of Grove Boulevard;
(d)
south along the west curb of Grove Boulevard to its intersection with the south curb of Riverside Drive;
(e)
east along the south curb of Riverside Drive to its intersection with the east curb of Vargas Road;
(f)
north along the east curb of Vargas Road to its intersection with the south curb of Montana Street;
(g)
east along the south curb of Montana Street to its intersection with the east curb of Valdez Street;
(h)
north along the east curb of Valdez Street to its intersection with the north curb of Ponca Street;
(i)
west along the north curb of Ponca Street to its intersection with the east curb of Vargas Road;
(j)
north along the east curb of Vargas Road to its intersection with west curb of U.S. Highway 183;
(k)
north along the west curb of U.S. Highway 183 to its northernmost intersection with the west curb of Montopolis Drive; and
(l)
south along the west curb of Montopolis Drive to its intersection with the north curb of Grove Drive, the point of beginning.
(B)
Except as provided in Subsections (C) and (D), a person commits an offense if the person carries or exercises control over a glass container that is open or has been opened on public roadway or sidewalk in a glass container area.
(C)
This section does not apply to a person at a sidewalk cafe licensed under Chapter 14-4 ( Sidewalk Cafes ).
(D)
This section does not apply to:
(1)
a baby bottle containing a product for consumption by a baby;
(2)
a glass drug container containing a prescribed drug;
(3)
a glass-lined vacuum picnic container or thermos bottle; or
(4)
a container permitted by Section 28.10(b) ( Consumption Restricted to Premises; Exceptions ) of the Texas Alcoholic Beverage Code.
(E)
It is a defense to prosecution under this section that the person is on the sidewalk in front of or within 150 from:
(1)
the person's residence; or
(2)
a residence where the person is a guest of the owner or occupant.
(F)
An offense under this section is by a fine of not less than $1.
