§ 9-5-63. FACTORS RELATING TO ARREST FOR VIOLATION.

  • (A)

    In making a determination that a person is in violation of this article, a peace officer may consider whether the person:

    (1)

    is a known drug dealer;

    (2)

    is at a location frequented by persons who use, possess, or sell drugs;

    (3)

    repeatedly engages in conversation with persons passing by on foot or in a vehicle; or

    (4)

    repeatedly gives or receives money, objects, or written material to or from persons passing by on foot or in a vehicle.

    (B)

    A peace officer may not arrest a person for a violation of this article unless the officer gives the person an opportunity to explain the person's conduct.
