§ 4.3. REZONING IF DEVELOPMENT APPLICATIONS EXPIRE OR ARE NOT APPROVED.

The director of the Neighborhood Planning and Zoning Department shall request that the council initiate the rezoning of property in a PUD zoning district if:

A.

a preliminary plan or site plan for a portion of the property is not approved within three years after the effective date of the ordinance approving the PUD zoning classification for the property; or

B.

an approved preliminary plan or site plan expires.
