§ 25-2-711. APPLICABILITY.

(A)

This division applies in the waterfront overlay (WO) combining district.

(B)

The requirements of this division do not apply to:

(1)

a community events use; or

(2)

the construction or reconstruction of existing or proposed development for which:

(a)

a building permit was issued before July 18, 1986;

(b)

a certificate of occupancy was issued before July 18, 1986;

(c)

a site plan was approved before July 17, 1986, including a phased project or a special permit site plan;

(d)

a site plan was filed with the City before July 17, 1986 as a condition of zoning, and the site plan was previously approved by the council or Town Lake Task Force; or

(e)

building plans were filed with the City before July 17, 1986.

(C)

The requirements of this division supersede the other provisions of this title, to the extent of conflict.
