§ 25-8-282. WETLAND PROTECTION.

(A)

Wetlands must be protected in all watersheds except in the bounded by Interstate 35, Riverside Drive, Barton Springs Road, Lamar Boulevard, and 15th Street.

(B)

Protection methods for wetlands include:

(1)

appropriate setbacks that preserve the wetlands or wetland functions;

(2)

wetland mitigation, including wetland replacement;

(3)

wetland restoration or enhancement; or

(4)

use of a wetlands for water quality controls.

(C)

The director of the Watershed Protection Department may approve:

(1)

the removal and replacement of a wetland; or

(2)

the elimination of setbacks from a wetland that is proposed to be used as a water quality control.
