§ 30-2-58. COUNCIL ACTION ON PRELIMINARY PLAN.

(A)

If a concurrent application described in Subsection 30-2-53(A)(1), (2), (3), (4), or (5) (Concurrent Applications) was filed with a preliminary plan, the council shall consider and act on the preliminary plan and the concurrent application after receiving a recommendation from the land use commission.

(B)

The land use commission's decision on an application for preliminary plan approval that is connected with a request for a variance from an environmental regulation may be reviewed by council if the land use commission's decision on the variance is appealed to the council.

(C)

The council shall approve a proposed preliminary plan that complies with the comprehensive plan and the requirements of this title.
