The Owner/Developer and the Contractor are solely responsible for the location and
protection of any and all public utility lines and utility customer service lines
in the work area. The Contractor shall exercise due care to locate, mark, uncover
or otherwise protect all such lines in the work area.
Neither the Owner/Developer nor the Contractor shall begin work in the area until
the One-Call Center has been notified, a One-Call Notification Number issued and the
Owner and/or the Contractor can assure that the locations of all lines and utilities
are marked.
Upon request, the utility owners shall provide information on the location and grade
of water, wastewater, gas, storm sewer, and telephone and electric lines and other
utilities in the work area. The availability of such information, however, shall not
relieve the Owner/Developer or the Contractor of the obligations hereunder, which
shall be primary and non-delegatable. Any such lines damaged by Contractor's operations
shall be immediately repaired by the Contractor upon the concurrence of the repair
of the utility; or the Owner/Developer shall cause such damage to be repaired at the
Contractor's expense.
