§ 14-11-194. PERMIT EXPIRATION FOR NON-PERFORMANCE.
(A)
A permit for a network node, node support pole, or transport facility expires due to non-performance:
(1)
on midnight of the 183 rd day following the date the permit is approved if installation has not commenced by that date;
(2)
on midnight of the 90th day following the date installation of the permitted node, node support pole, or transport facility commenced if installation is not completed by that date; and
(3)
on midnight of the 65 th day following the date installation is complete if the node, node support pole, or transport facility is not in providing or supporting the provision of wireless services as of that date.
(B)
The director may grant a one-time extension for up to 30 days to an expiration date in this section, provided the director determines in his sole discretion that the network provider has shown good cause for granting the extension. Good cause is determined in the director's sole discretion and, in any event, must be due to circumstances entirely outside of the network provider's control and may not in any way be the result of a business decision or market forces.
