§ 5-5-8. TESTING FOR AIDS; WHEN PERMITTED.

  • No person shall require another to undergo any medical procedure or test designed to show or help show whether a person has AIDS, or is an HIV-infected individual, as defined in Section 5-5-2 ( Definitions ), unless the testing is necessary as a bona fide occupational qualification. Nothing in this section shall be construed to prohibit any blood bank, blood center or plasma center or any medical facility which procures, processes, distributes, or uses a donated human body part from conducting any test for medical acceptability of blood, plasma or the body part.
