Division 1. General Provisions. |
§ 6-1-2. APPLICABILITY.
(A)
Except as provided in Subsection (B), this article applies within the City's zoning jurisdiction.
(B)
This article does not apply:
(1)
to a person studying or researching the effect of a release of an ozone-depleting compound into the environment, or developing an alternative technology, if use of an ozone-depleting compound is required for the study, research, or development;
(2)
to a halon fire extinguishing system for military or aviation use;
(3)
to a licensed health care facility, including medical research conducted at the facility, except for the facility's air conditioning system;
(4)
to a manufacturer of a "drug" or "device", as defined by United States Code Title 21, Section 321, except for the facility's air conditioning system, if the manufacturer:
(a)
is required to register under United States Code Title 21, Section 360; and
(b)
recycles refrigerant, if any.
