§ 6-2-4. MATERIALS NOT REGULATED.

The following materials are not regulated by this chapter:

(1)

a material used or stored at a private residence;

(2)

a material contained in a transportation vehicle;

(3)

a material in a product intended for distribution to the general public, except firearm ammunition or a liquid with a flammability rating of three or greater;

(4)

a commercially-available janitorial or maintenance product that is for use on the premises of an above-ground storage facility;

(5)

an inert gas;

(6)

a radioactive material regulated by the Department of Health under Chapter 401 ( Radioactive Materials And Other Sources Of Radiation ) of the Texas Health and Safety Code; and

(7)

a waste material regulated by the Department of Health or the Texas Environmental Quality Commission under Chapter 361 ( Solid Waste Disposal Act ) of the Texas Health and Safety Code.
