§ 1805S.3. Protection of Adjoining Property

The Owner/Developer shall be responsible for and shall require the Contractor to undertake proper means to protect the adjacent or adjoining property or any private properties, encountered in any way, which might be injured or seriously affected by any process of construction of the Work from any damage or injury by reason of said process of construction. The Owner/Developer shall be liable for any and all claims of such damage on account of the Owner/Developer 's failure to fully protect all adjoining property or any private properties encountered in any way. The Owner/Developer shall agree to indemnify, save and hold harmless the City of Austin its agents and employees against any claim or claims for damages due to any injury to any adjacent or adjoining property arising or growing out of the performance of the Work regardless of whether or not the damage or injury is caused in part by a party indemnified hereunder.
