§ 11-1-70. NOTICE OF DENIAL; APPEAL.

(A)

If the director determines that the applicant is not eligible for an abatement, the director shall notify the applicant in writing by United States mail sent to the address shown on the application.

(B)

An applicant may appeal the director's decision to the Planning Commission. To appeal, the applicant must file a written request with the director not later than the 31st day after the date written notice of the decision is given to the applicant.

(C)

On appeal, the Planning Commission shall consider only whether the director erred in determining that the applicant is not eligible for the abatement under Section 11-1-68 ( Review By Director; Criteria ).
